The petitioner apprehends his arrest in connection with Special Case No.10474 of 2019 arising out of Athmalgola P.S. Case No. 215 of 2019 registered for the offence under Sections 30(a)(d) and 37(b)(c) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery of liquor has been made from the bush which has no concern with the petitioner. The petitioner may be granted the privilege of anticipatory bail.

Case No. 215 of 2019 subject to the conditions laid down under Section 438(2) Cr.P.C.
