JUSTICE MIHIR KUMAR JHA ORAL ORDER 27-02-2015 Heard learned counsel for the parties as also taking into account the allegation against the petitioners for the offences punishable under Sections-341, 323, 324, 307, 504 and 34 of the Indian Penal Code and the solitary defense of the petitioners that there is a counter case also for the same occurrence being Barharia P.S. Case No. 185 of 2014, this Court is not inclined to grant anticipatory bail to the petitioners for a simple reason that five incised injuries on different parts of the body of the injured has been found by the Doctor. Thus, the occurrence is being admitted and the injuries now being found on the person of the injured, this Court is not inclined to grant anticipatory bail to the petitioners.
Patna High Court Cr.Misc. No.37184 of 2014 (2) dt.27-02-2015 The prayer for anticipatory bail of the petitioners is hereby rejected.
Nothing said in this order, however, will come in the way of the petitioners in surrendering before the Court below and praying for regular bail.
