JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-03-2023 The present writ petition has been filed seeking the following relief:- "1. That this writ application is being filed for directing the respondents authorities especially the District Magistrate, Bettiah (Respondent No. 2) to take a final decision on the application filed by the petitioner for grant of D.B.B.L.Gun license, to direct the District Magistrate (Respondent No. 2) to grant an arms license and other relief or reliefs to which the petitioner is found entitled during the course of hearing of the writ application."

At the outset, the learned counsel for the petitioner

Patna High Court CWJC No.4107 of 2023(2) dt.29-03-2023 2/2 submits that since the application for grant of arms license was filed in the year, 2016, whereafter the new Arms Rules, 2016 have come into force, the petitioner be granted liberty to file a fresh application for grant of arms license, after complying with the requisite formalities, as prescribed in the new Arms Rules, 2016, however, seeks a direction upon the District Magistrate, West Champaran at Bettiah to dispose off the same, within a fixed time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file a fresh application for grant of arms license, after complying with the prescribed formalities, as contained in the new Arms Rules, 2016 and in case, such an application is filed before the District Magistrate, West Champaran at Bettiah, within a period of four weeks from today, the same shall be disposed off, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter. The writ petition stands disposed off on the aforesaid terms.
