Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

It is alleged that 35 liter of Mahua liquor was recovered from road side.

Recovery is from an open place. The name of the petitioner transpired only on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner,

Patna High Court CR. MISC. No.20180 of 2023(3) dt.15-05-2023 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise II Aurangabad in connection with Tandwa Police Station Case No 13 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
