Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 506, 504, 498A/34 of the Indian Penal Code.

Informant in her written complaint has alleged that she was married to Nirala Kumar @ Sachin on 15.02.2017 and thereafter she went to her matrimonial home, where, she was being tortured by her in-laws for non fulfillment of demand of dowry.

It has been submitted on behalf of the petitioners that they are living separately and are not concerned with the affairs

No.28133 of 2021(2) dt.17-06-2021 2/3 of family of Informant and her husband and due to strained relations between husband and wife all family members have been implicated in this case. Petitioner no.1 is the bhaisur and petitioner no. 2 is Jethani of Informant. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Nathnagar (Madhusudanpur) PS Case No. 455 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the court below.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
