This is an application for bail in connection with NDPS Case No. 11 of 2017, arising out of Ara Town P.S.Case No. 161 of 2017 registered for the offences punishable under Section 21(b) of N.D.P.S. Act.

Allegation is of recovery of 13 grams of heroin from one lady sitting in tempo and petitioner is said to be driver of tempo. Submission of learned counsel for the petitioner is that FIR itself shows that seizure is from the possession of the lady and that lady has named this petitioner and on that basis he is made accused in this case and he is in custody for five months, having no criminal antecedent.

No.55232 of 2017 (2) dt.20-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Bhojpur, Ara, in connection with NDPS Case No. 11 of 2017, arising out of Ara Town P.S.Case No. 161 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
