This application for regular bail arises out of Bettiah Muffasil P.S. Case No. 702 of 2019, disclosing offence punishable under Sections 379, 411, 413 of the Indian Penal Code.
The petitioner is in custody since 31.12.2019. According to the First Information Report, some miscreants were attempting to take away the informant's Bolero vehicle stealthily, when one of the miscreants was apprehended. It is alleged in the FIR that the said apprehended accused disclosed the petitioner's name as his accomplice.
Learned counsel appearing on behalf of the petitioner has submitted that apparently there is no recovery from the
Patna High Court CR. MISC. No.16101 of 2020(2) dt.02-06-2020 2/2 petitioner's possession and no offence punishable under Section 411 of the IPC can be said to be made out against the petitioner. Considering the submission that confessional statement of co-accused, apprehended by private persons, is the only basis for implication of this petitioner in the present case, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in Muffasil P.S.
