JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 470 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act.

The accusation is that, on receiving secret information about selling of illicit Nepali Liquor, the informant being the Assistant Sub-Inspector of Muffasil Police Station reached at the door of the petitioner and recovered 48 piece, each containing 300 ml, Nepali liquor kept in plastic bag, while the petitioner succeeded to flee away.

No.55136 of 2017 (2) dt.21-11-2017 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
