Petitioner, who is languishing in judicial custody since 29.05.2017, seeks bail in connection with Vijayipur P.S. Case No. 160/2016 for offences punishable under Sections 363, 366-A/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while her daughter Laxmi Kumari, aged 15 years, went out of the house to attend the call of nature, the petitioner along with Sohan Turha and Chunnu Turha kidnapped her daughter in a motorcycle with the help of other accused.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.60635 of 2017 (2) dt.20-12-2017 2/2 petitioner that the victim girl was in love with Chunnu Turha and solemnized marriage with him. The doctor has assessed her age to be 17-18 years and the victim girl also in her statement under Section 164 of the Cr.P.C. has stated that she was made unconscious.

Earlier the bail application of the petitioner filed along with Chunnu Turha being Cr. Misc. No. 34212 of 2017 was rejected on 31.08.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned IVth Addl. Chief Judicial Magistrate, Gopalganj, in connection with Vijayipur P.S. Case No. 160 of 2016.
