JUSTICE SANJAY PRIYA ORAL ORDER 25-07-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sri Nagar P.S. Case No.08 of 2018 instituted for the offence under Sections 341, 342, 323, 302 and 504/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Madhepura. In the written report, there is specific allegation against the petitioner of assaulting brother-in-law of the informant with iron rod on the neck from back side on account of which he became unconscious and fell down. He subsequently died. Case diary has been received.

Learned A.P.P. after looking into the case diary has submitted that the witnesses have supported the case levelling allegation against the petitioner. The post mortem report is

Patna High Court Cr.Misc. No.37469 of 2018 (3) dt.25-07-2018 2/2 available in paragraph-37 of the case diary wherein the doctor has found injuries on the vital part of the body of the deceased caused by hard and blunt substance.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
