====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 19-04-2019 Heard learned counsel for the applicant.
The bail of the applicant had been granted by this Court on 17th of January, 2019 by the following order: "The petitioner is alleged to have been in possession of 10 grams of Ganja and the contention is that it was a private dispute and the nature of recovery being private, the offence being bailable, the bail deserves to be granted.
The argument prima facie is correct.
In view of the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Kanti P.S. Case No.563 of 2018." However, certain corrections were prayed for
Patna High Court CR. MISC. No.21593 of 2019(2) dt.19-04-2019 2/2 subsequently which was disallowed, but with liberty to file a fresh bail application after recalling the order on 22nd February, 2019.
This is how this bail application has been filed with the same prayer and in respect of the same allegations. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge, Muzaffarpur in connection with Kanti P.S. Case No.563 of 2018."
