The petitioner seeks bail in connection with Jahanabad P.S. Case No. 339/2012 dated 04.10.2012 instituted for the offences under Sections 420, 406, 467, 468, 469, 471 and 120B of the Indian Penal Code.

The petitioner is alleged to be the A.G.M. of Sanjivani Buildcom Pvt. Ltd., Ranchi, which company had projected itself as a company dealing in sale and purchase of land in Jharkhand. The informant has alleged that being satisfied with the profile of the company, he had deposited a huge amount for purchase of land at Ranchi, but neither the land was vended to her nor the money

Patna High Court Cr.Misc. No.53179 of 2017 (3) dt.08-12-2017 2/2 was returned.

Learned counsel for the petitioner has submitted that now the entire money has been returned, which fact gets reflects from Annexure-2.

The aforesaid company has been made accused in about 32 cases, but the petitioner in his capacity as an employee in the aforesaid company has been charge-sheeted in six of them and in all such cases, he is on bail.

Regard being had to the fact that the money of the complainant has been returned and in other cases, the petitioner is on bail, this Court is inclined to grant bail to him. While saying so, this Court has also taken note of the fact that the petitioner has remanded in custody since 24.08.2017.

The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge I, Jehanabad in connection with Jehanabad P.S. Case No. 339/2012.
