The present application has been preferred: for issuance of a writ in the nature of certiorari for quashing the Letter No.1141 dated 9.6.2025 and Letter No.1947 dated 29.10.2025 issued under the signature of Circle Officer, Naubatpur (Respondent No.6) in the name of Executive Engineer, Electric Supply Division, Patna Rular, Total bearing Area 55.99 decimal whereby and whereunder the petitioners part of land, bearing Khata
Patna High Court CWJC No.4835 of 2026(3) dt.30-06-2026 2/3 No.151, Plot No.110, Mauza-Gopalpur, Thana No.166, Naubatpur, Patna given to Excutive Engineer Electric Supply Rulas Division, Patna, Rular for construction without notice to the petitioners, treating the land as Govt. land i.e. "Gairmajarua Aam Parti Kadim" land but it is "Gairmajarua Malik Parti Kadim" land, which is settled by Ex-Landlord in Fasli year 1350 in favour of ancestor of vendors of petitioners, and against the S.D.O. Naubatpur order dated 26.10.2013 as well as C.0.Naubatpur order passed in Encroachment Case No.02/198283 and order passed in T.S.No.145/2014 order/judgment dated 14.9.2015 passed in Khata No.115, Plot No.
110, 221, filed by similarly situated persons whose land is also taken in same Khata/Plots and also issuance of a writ in the nature of mandamus directing and commanding the Respondent Authorities to not disturb the possession of the petitioners, regarding the land and restraining from carrying out any construction of the alleged land as mentioned in Letter No.1141 dated 9.6.2025 and 1947 dated 29.10.
Patna High Court CWJC No.4835 of 2026(3) dt.30-06-2026 3/3 on representation filed by petitioners, as deem fit and proper.
3. After some argument, learned counsel for the petitioner submits that it will suffice if his case is sent to the office of the Collector, Patna for the redressal of the grievance.
4. Learned State Counsel has no objection.
5. In that background, the writ petition is disposed of allowing the petitioner to submit a proper representation before the Collector, Patna who shall be looking into the matter, seek report from the Circle Officer, Naubatpur, Patna and then pass an appropriate order in accordance with law.
