The petitioner, being the mother-in-law of the daughter of the informant, is languishing in custody since 15.11.2018 in connection with Atri P.S. Case No.284 of 2018 registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.
Prosecution case as per the written report of Sheo Nandan Prasad submitted to Atri P.S. is to the effect that the informant's daughter was married with the son of the petitioner four years back after lodging of the case, but subsequent to marriage, further demand of a motorcycle was made and for non-fulfilling of the same, torture was inflicted upon the daughter of the informant. On 16.08.2018, the informant
Patna High Court CR. MISC. No.16710 of 2019(2) dt.26-03-2019 2/2 received the information that his daughter is seriously ill whereupon, informant along with his son rushed to her matrimonial house and found his daughter dead. It is submitted by learned counsel for the petitioner that no specific accusation has been made against the petitioner and the thrust of the accusation is against the husband of the victim, who is in custody. It is further submitted that the investigation has already been concluded and petitioner is a lady.
Learned APP for the State submits that the petitioner is named in the FIR.
Considering the fact that the petitioner is lady and investigation has already been concluded coupled with the fact that the thrust of accusation is against the husband of the victim who is in custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Gaya in connection with Atri P.S. Case No.284 of 2018.
