The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/353 of the Indian Penal Code.

The prosecution story in nutshell is that the informant being the Sub Inspector was on patrolling duty on 26.01.2022. In course of patrolling he saw a tractor laden with sand was coming and when he tried to stop the vehicle then the driver of the vehicle-cum-petitioner drove very rashly and tried to run over the informant.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has

Patna High Court CR. MISC. No.18921 of 2022(3) dt.03-11-2022 2/2 falsely been implicated in the present case. The name of the petitioner is disclosed by the co-villagers. It is further submitted that neither the petitioner is apprehended from the spot nor anything incriminating has been recovered from his conscious possession. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - II, Jamui in connection with Simultala P.S. Case No. 09 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
