The petitioners seek regular bail in connection with Sasaram (Model) P.S. Case No. 352 of 2017 for the offences punishable under Section 379 of the Indian Penal Code. The allegation is regarding the accused persons having been apprehended with stolen motorcycle by the police. The learned counsel for the petitioners submits that the petitioners are innocent and similarly situated co-accused persons have already been granted bail. Nonetheless, it is submitted by the learned counsel for the petitioners that the petitioners are ready to abide by whatever terms and conditions which may be imposed by the concerned court.
Patna High Court Cr.Misc. No.33670 of 2018 (4) dt.25-07-2018 2/2 Considering the fact that the petitioners are having criminal history, I deem it fit and proper to direct the petitioners to deposit a sum of Rs.25,000/- each before the Najarat of the concerned Court.
Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioners on regular bail subject to producing the receipt of the deposit of Rs.25,000/- each upon such conditions as may deem fit and proper to be imposed by the concerned Court i.e Court of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No. 352 of 2017. It is needless to state that the aforesaid deposit of Rs.25,000/- each by the petitioners shall be subject to result of the present case.
