Petitioner, already in custody, seeks bail in connection with Bikram P.S. Case No.140 of 2018, registered under Sections 420 and 379 of the Indian Penal Code. Accusation in brief is that on suspicion police apprehended the petitioner and found in possession of one ATM belonging to some other person and the same ATM was exchanged by some person from its holder and Rs.22,500/- was withdrawn.
Learned counsel for the petitioner submits that no complaint or information was lodged with regard to exchange of the so called ATM found in possession of the
Patna High Court Cr.Misc. No.48670 of 2018(2) dt.07-08-2018 2/2 petitioner by anyone and the petitioner has no similar kind of antecedent, though he has two cases under the Arms Act in which he is on bail and the petitioner has been in custody for last three months and charge-sheet has been submitted. Having considered the aforesaid facts and circumstances, petitioner Mukesh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Danapur in connection with Bikram P.S. Case No.140 of 2018.
