The petitioner seeks bail in anticipation of his arrest in connection with Ganga Bridge P.S. Case No. 108 of 2012 dated 30.11.2012 instituted for the offence under Sections 20 and 22 of the N.D.P.S. Act.

Mr. Sunil Kumar, learned counsel for the petitioner after some argument seeks permission to withdraw this petition as report has been received from the Court below that the petitioner has been declared an absconder on

Patna High Court CR. MISC. No.18622 of 2020(5) dt.24-11-2020 2/2 23.12.2019.

The petition is dismissed as withdrawn.

However, if the petitioner surrenders before the court below and seeks bail, the court below shall take into account that nothing has been recovered from the possession of the petitioner and that similarly situated persons have been granted anticipatory bail by different Benches of this Court and shall pass orders in accordance with law without being prejudice by the fact that the present petition has not been entertained.

The Court below shall also take into account that the police did not send up the petitioner for Trial but differing with the police report, cognizance has been taken against him.
