The petitioner seeks bail in a case registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 12.12.2021, the petitioner is alleged to have abused and threatened the informant and thereafter, it is alleged that on next day i.e. on 13.12.2021, other accused persons, armed with various weapons, killed the son of the informant.

It is submitted on behalf of petitioner that so far as petitioner is concerned, there is only allegation of abuse and threatening. Petitioner is not the assailant of son of the informant. Petitioner claims clean antecedent and he is in custody since 16.12.2021.

Patna High Court CR. MISC. No.18745 of 2022(2) dt.26-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Siwan in connection with G.B. Nagar P.S. Case No. 312 of 2021.
