JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Kotwali (Jogsar) P.S. Case No. 811 of 2018, dated 29.11.2018, instituted for the offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
For a trifle, an occurrence of assault took place in which the petitioner is said to have assaulted the informant leading to lacerated/cut injury near his eyes. Though the injuries has been opined to be grievous by the Doctor, but the dimension of the injury reflects that it is just a cut by the

The learned Senior Counsel appearing for the petitioner has submitted that perhaps the location of the injury has made the Doctor opine, the injury to be grievous. Considering the background facts and the dimension of the injury, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Jogsar) P.S. Case No. 811 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
