The petitioner seeks bail in connection with Mohania P.S. Case No. 117 of 2015 dated 03.04.2015 instituted for the offences under Sections 420, 409 of the Indian Penal Code. The petitioner was granted anticipatory bail by a Bench of this Court and the petitioner had been participating in the Trial. But for his absence on one day i.e. on 08.03.2016, he had diligently been appearing before the Court below. The bail bond of the petitioner has been cancelled on 08.03.2016. The petitioner is in custody since 10.07.2017. In the facts stated above, this Court is inclined to grant bail to the petitioner.

No.55434 of 2017 (2) dt.08-01-2018 2/2 The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned 7th Additional Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 117 of 2015. It is also made clear that if the petitioner for no bona fide reason does not appear before the Court below on two consecutive dates, it will be open for the Court below to cancel his bail bonds again.
