JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Ladania P.S. Case No. 207 of 2019, registered under Sections 461, 379 and 511/34 of the Indian Penal Code. The accusation is that in course of patrolling duty at Khajadih Chura Mill, two persons were seen breaking the lock of one shop. On seeing the police party, they started to flee away, but on chased, they were apprehended, who disclosed their names as Suresh Kukar Yadav (petitioner) and Govind Kumar. On search, petitioner was found in possession of screw and one fighter (Panja) whereas Govind Kumar was found in possession of Pilas.
Patna High Court CR. MISC. No.16022 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioner submits that petitioner was apprehended by the police in course of patrolling duty mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 11.12.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Ladania P.S.
