JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-11-2023 The present writ petition has been filed seeking the following reliefs:- "(i) To issue a writ of Certiorari/ Mandamus and/or any other appropriate writ/writs order/orders direction(s) direction by quashing and setting aside thereby the impugned
Patna High Court CWJC No.5144 of 2022(2) dt.23-11-2023 2/3 communication/order dated 12-10-2021 issued by the respondent no.-2, IndusInd Bank Ltd., whereby and whereunder the appeal of this petitioner has been rejected arbitrarily in a mechanical manner without assigning any reason as how the findings of the enquiry (Annexure- 6) issued by the respondent no.-5 is just and fair when the deposition of this Petitioner (Page no.- of annexure-6) does not match with the deposition recorded by the respondent no.-5 (Page no.
- of annexure-6) and in the absence of any deposition of any witnesses or material indicating that there is specific mandatorily direction of the bank to the branch manager exists for checking /verification of signatures of the customer of the bank after the due diligence and verification already done by the competent authorized deputy branch manager, service delivery manager, the petitioner was dismissed from the employment of the bank by the order dated 09-06-2021 (Annexure-8) issued by respondent no. 4 and confirmed the order of the respondent no.
(ii). To quash and set aside the impugned final order dated 09- 06-2021 issued by respondent no. 4 (Annexure- 8);
(iii).
To consequently direct the respondents to revoke the dismissal order of the Petitioner and to take the joining of the petitioner in the same capacity of his employment before of the
Patna High Court CWJC No.5144 of 2022(2) dt.23-11-2023 3/3 termination with all attached benefits.
(iv). To hold and declare the impugned action of the Respondents particularly respondent no. 2, 4, 5 and 6 as illegal, bad in law and contrary to the mandate of the principles of natural justice." 2.
After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law including that of filing a suit before the Ld. Civil Court having competent jurisdiction. Liberty, so sought, is granted. 3.
