KUMAR ORAL ORDER 15-01-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Special Case No. 20 of 2017 arising out of Pandarak P.S.Casxe No. 105 of 2016 registered for offences punishable under Sections 363/365 of the Indian Penal Code and subsequently, Sections 366A and 342 of the Indian Penal Code R/W P.O.S.C.O. Act has also been added on the basis of statement of victim under Section 164 of the Cr.P.C.

The prosecution case as lodged on the basis of written report is that his daughter, Deepa Kumari had gone to S.B.R., College, Barh but did not return and after much search she could not be found and her mobile was also switched

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. The victim, Deepa kumari, 17 years old herself denied of any sexual assault against the petitioner under Section 164 of the Cr. P. C. In her deposition before the trial court, she has denied the allegation of kidnapping. It is further submitted that the petitioner has no criminal antecedent and the petitioner is in custody since 17.08.2016.

Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge,1st, Patna in connection with Special Case No. 20 of 2017arising out of Pandarak P.S.Case No. 105 of 2016.
