Smt. Asha Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Shankarpur P.S. Case No. 63 of 2018 registered under Sections 379 and 411 of the Indian penal Code. Allegation in brief is that petitioner was apprehended raid handed by carrying away stolen motor pump installed in the residential premises of the informant.

Submission is that the petitioner has falsely been implicated and there is no recovery of stolen electric motor pump worth Rs. 4,500/- from the possession of the petitioner and he has no criminal antecedent and has been in custody for more than two months.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Mantosh Sardar, is directed to be released

Patna High Court Cr.Misc. No.48673 of 2018(2) dt.07-08-2018 2/2 on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-1st, Madhepura in connection with Shankarpur P.S.
