The petitioner seeks bail in Uchakagaon P.S. Case No. 200 of 2018, instituted for the offence under Section(s) 302 and 120(B) of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence Tauhid Khan @ Laddu Khan gave dagger blow in the chest of brother of the informant, on account of which, he succumbed to the injury during course of treatment. The learned Sessions Judge has mentioned in the impugned order that as per the post mortem report one injury has been found on the chest of the deceased which was grievous in nature. The aforesaid injury has been attributed in the written report specifically against co-accused Tauhid Khan

Patna High Court CR. MISC. No.21398 of 2019(3) dt.30-05-2019 2/2 @ Laddu Khan. There is no allegation of any specific overt act against the petitioner.

Petitioner is in custody since 23.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II, Gopalganj, in connection with Uchakagaon P.S. Case No. 200 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
