=========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 08-08-2017 None present.
Seeking exception to an order passed by the learned Writ Court on 05.02.2016 in C.W.J.C. No. 16598 of 2014, this appeal has been filed.
Finding various infirmities in the payment of Family Pension certain orders have been passed with regard to entitlement of the appellant to claim Family Pension after death of his wife who was working as a Primary Teacher.
Patna High Court LPA No.1107 of 2016 dt.08-08-2017 2/2 The learned Writ Court finding no infirmity in the order passed by the Accountant General and the Accounts Officer denying arrears of pension to the appellant has refused to interfere into the matter by holding that a widow or a widower is ineligible to such pension on their remarriage and after taking note of various aspects of the matter the question of granting benefit to the appellant after death of his wife has been decided.
We find no error in the same warranting reconsideration. The Letters Patent Appeal is dismissed.
