The petitioners seek bail in connection with a case registered for the offence punishable u/s 302, 201, 120B of the IPC.

As per the prosecution case, the allegation against the petitioner is that he, in association with other co-accused persons killed the son of the informant and concealed his dead body beneath sand loaded in a truck.

It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation
Patna High Court CR. MISC. No.18221 of 2025(2) dt.19-03-2025 2/2 against the petitioners. It is further submitted that the postmortem report has not supported the prosecution case. There is no eye witness to the alleged occurrence. Petitioner has been made accused only on the basis of suspicion. It is further submitted that the similarly situated co-accused has already been granted bail by this Court vide order dated 24.01.2025 passed in Cr. Misc. No. 81524 of 2024. The petitioners have no criminal antecedent and they are languishing in judicial custody since 06.02.2025.

Learned APP for the State opposed the prayer for bail. 6.
Considering the facts and circumstances of this case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Jehanabad P.S. Case No.463 of 2024.
