The petitioner seeks bail in connection with Bhaptiyahi P.S. Case No. 56 of 2017 registered under Section 302/34 of the Indian Penal Code.

The petitioner along with four other accused persons are said to have assaulted the brother and wife of the informant by means of leg, fist and rod over planting the jute crop in their filed by the accused persons and the wife of the informant succumbed to her injuries.

It is submitted by learned counsel for the petitioner that no occurrence as alleged ever took place. The allegation levelled against the petitioner is not specific rather omnibus.

Patna High Court Cr.Misc. No.55077 of 2017 (2) dt.14-12-2017 2/2 Doctor conducting the autopsy of the cadaver has not found any external injury on the person of the deceased as ante mortem injury and reserved its opinion regarding cause of death till chemical analysis of the viscera. The petitioner has been languishing in custody since 05.07.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi P.S. Case No. 56 of 2017.
