Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Narpatganj P.S. Case No. 700 of 2018 (G.R. No. 3886/2018), registered for the offences punishable under Sections 447, 341, 354(B), 323, 379, 386, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.
Patna High Court CR. MISC. No.15923 of 2020(2) dt.14-07-2020 2/2 Allegation against these petitioners is that they were cutting ridge of the land of informant. When the informant objected they abused him. On alarm, the wife of informant came and the accused persons started assaulting her and snatched her Mangalsutra. Petitioner no. 1 and 2 demanded extortion of Rs. One lakh. Petitioner no. 1 took out his pistol and fired in the air. It is submitted that petitioners have been falsely implicated in this case. There is land dispute between the parties and the scuffle took place on the same piece of land. There is case and counter case. The entire allegation are false and concocted.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 700 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
