ANJANA MISHRA ORAL ORDER 23-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 08.06.2018 in connection with Pocso Case No.28 of 2016 arising out of Bakhtiarpur (Kanaria O.P.) P.S. Case No.259 of 2016 for the offence registered under Sections 363, 366A, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that save and except the allegation against this petitioner is that he was present at Himachal Pradesh where the victim lady has been taken, there is no further allegation against the petitioner and he has no criminal antecedent.

No.45346 of 2018 (2) dt.23-08-2018 2/2 From perusal of the record, it appears that the main accused, Anil Bharti, has since been grant provisional bail vide order dt.16.05.2017 passed in Cr. Misc. No.16851 of 2017, on the condition that he will marry with the victim girl, as it is the case of love affairs.

Considering the aforesaid facts and circumstances of the case and the fact that no specific role has been attributed to the present petitioner and that he has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, Saharsa, in connection with Pocso Case No.28 of 2016 arising out of Bakhtiarpur (Kanaria O.P.) P.S. Case No.259 of 2016 (Anjana Mishra, J) Sanjeev/- U T
