The petitioner is apprehending his arrest in connection with Gangabridge P.S.Case No.157 of 2018 dated 7.11.2018 , registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of more than 1000 ltrs. of liquor from a truck and the petitioner was named along with Sunil Roy and Pramod Roy and others. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case on the basis of suspicion and he has no criminal antecedent and the other coaccused person who are named have been released on anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 19.2.2019 passed in Cr. Misc. No.9633 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vaishali at Hajipur in connection with Gangabridge P.s.Case No.157 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
