JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2017 The petitioner seeks regular bail in connection with Pandaul P.S. Case No. 267 of 2015, registered for offences punishable under Sections 504, 341, 323, 32 and 307/34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant by means of garasa causing injury to him. It has been submitted on behalf of the petitioner that there is case and counter case between the parties and the occurrence took place in spur of moment and there was no intention of the petitioner to kill the informant. Petitioner has been in custody since 29.08.2017.
Learned counsel for the State opposed the prayer for bail on the ground that the injuries caused to the informant was found
Patna High Court Cr.Misc. No.52644 of 2017 (2) dt.14-11-2017 2/2 to be grievous in nature.
Having heard both sides, considering the facts and circumstances of the case and also the injury being grievous in nature, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petition to his own satisfaction once charge is framed in this case with the condition that he will cooperate in disposal of trial.
