====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 16-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Gurua P.S. Case No. 201 of 2024, registered for the offences under Section 392 of the Indian Penal Code.
3. As per the prosecution case, three armed miscreants snatched the bag of the informant on gun point. The bag contained Rs. 5 lakh in cash and cheque book and other documents of the informant who has been running CSP of Bank of India. The name of the petitioner transpired during investigation for being involved in the robbery.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has
Patna High Court CR. MISC. No.17968 of 2025(2) dt.16-04-2025 2/3 ever taken place. The petitioner was earlier apprehended and remanded in Gurua P.S. Case No. 82 of 2024 on 27.07.2024 and thereafter he has been remanded in this case on 09.12.2024. Police took this petitioner on remand and recorded his confessional statement and it is alleged that the petitioner confessed his guilt about involvement in the present case. Learned counsel further submits that except the confessional statement of the petitioner there is no other material to show the involvement of the petitioner in the instant occurrence. The petitioner has not been put to any Test Identification Parade though the informant stated that she would identify one of the miscreants. Charge sheet has been submitted. The petitioner is accused in six more cases and he is on bail in all such cases.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery of any incriminating article has been shown from the petitioner and considering his period of custody and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like
Patna High Court CR. MISC. No.17968 of 2025(2) dt.16-04-2025 3/3 amount each to the satisfaction of learned C.J.M., Sherghati, Gaya/concerned court, in connection with Gurua P.S. Case No. 201 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
