Petitioner, already in custody, seeks bail in connection with Special Case No.143 of 2017, arising out of Khusrupur P.S. Case No.201 of 2017, registered under Sections 20 and 22 of the N.D.P.S. Act.
Allegation in brief is that 70 gms. of Ganja was recovered from possession of the petitioner and he is alleged to be indulged in selling narcotics.
Learned counsel for the petitioner submits that the alleged recovery of 70 gms. Ganja is small quantity, there is no evidence that the petitioner was found selling narcotic, he has clean antecedent, police has submitted charge-sheet and he is in custody since 29.09.2017.

No.60925 of 2017 (2) dt.19-12-2017 2 /2 Having considered the said facts and circumstances, let petitioner, Harendra Rai, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Patna in connection with Special Case No.143 of 2017, arising out of Khusrupur P.S. Case No.201 of 2017 with condition that one of the bailors must be the family member of the petitioner and the petitioner is directed to present physically on each and every date as and when required before the trial court and in case of absence on two consecutive dates without any medical emergency, his bail bond shall liable to be cancelled.
