JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Barauni (Refinery) Police Station Case No. 407 of 2014 for the offences instituted under Sections 323, 341, 406, 420, 504/34 of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
Prosecution case, in short, is that on the allurement of getting job petitioner has taken Rs.2,50,000/- from the informant and gave him three blank forms and said to deposit it to the Railway Office, Kolkata, and receive the joining letter. When the informant went there, they knew that he has been cheated. He returned and told the accused to return his money but they were ignoring him and finally on 28.03.2014 they assaulted and abused the informant and told him that they would not return his money.
Patna High Court Cr.Misc. No.29802 of 2015 (2) dt.29-07-2015 2/2 The accusation is of demand of dowry and on nonfulfilment of the same torture was inflicted by the accused. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that due to mistake of fact he has been falsely implicated. He has further submitted that petitioner is ready to jointly deposit an amount of Rs.15,000/- in the Court below, which shall be subject to the final disposal of the case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall jointly deposit an amount of Rs. 15000/- in the court below which shall be subject to the final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Barauni (Refinery) P.S. Case No. 407 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
