====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 25-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Tariyani P.S. case no. 50 of 2015 instituted for the offence under Section(s) 304B and 201/34 of the Indian Penal Code.

This is the third anticipatory bail application filed on behalf of the petitioner. Second anticipatory bail petition filed on behalf of the petitioner was rejected by this Court by order dated 12.7. 2017 passed in Cr. Misc. no. 43474 of 2016 with direction to the petitioner to surrender before the court below and make prayer for regular bail. The petitioner did not surrender in compliance of the aforesaid order. The instant application has been filed on the ground that husband of the deceased has already been acquitted by learned

Patna High Court Cr.Misc. No.44038 of 2018(2) dt.25-07-2018 2/2 Trial Court.

This Court does not find it a good ground to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of petitioner has already been rejected twice by this Court. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by this order.
