JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Katihar Muffasil P.S. Case No.196 of 2018 registered for the offences punishable under Sections 366(A), 341, 342, 376, 511, 34 of the Indian Penal Code and Section 4 of POSCO Act. Allegation as per F.I.R. against the petitioner is of kidnapping the daughter of the informant and it is alleged that the petitioner has forcibly taken her and on the pressure of the society, he handed over the same. Statement of the girl has been recorded under Sections 161 and 164 of Cr.P.C., in which she has supported the allegation of kidnapping as well as rape. Submission of the learned counsel for the petitioner is that charge sheet has been submitted, in which no charge under Section 4 of POSCO Act has been made out against this petitioner and medical report has also not supported the

Patna High Court CR. MISC. No.17521 of 2019(3) dt.21-05-2019 2/2 prosecution case. Further submission is that petitioner is in custody since 28.11.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

With the above observations, this application is dismissed.
