JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2024 The present petition has been filed for restoration of a petition bearing CWJC No. 11925 of 2022, which has stood dismissed on account of non-compliance of the peremptory order dated 02.11.2022.

The learned counsel for the petitioner
Patna High Court MJC No.719 of 2023(3) dt.25-01-2024 2/3 has submitted that though the earlier counsel for the petitioner had given a 'No Objection' to the petitioner, whereafter, the present counsel had entered appearance but during the interregnum period, the peremptory order dated 02.11.2022 was passed, about which the present counsel was not having knowledge, thus the aforesaid writ petition had stood rejected on 16.11.2022 on account of non-compliance of the peremptory order dated 02.11.2022, hence it is submitted that a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid petition bearing CWJC No. 11925 of 2022 to its original file, subject to removal of the defects pointed out by Registry, within a period of four weeks from today. 4.
The present petition stands disposed of
Patna High Court MJC No.719 of 2023(3) dt.25-01-2024 3/3 on the aforesaid terms.
