2. The petitioners apprehend their arrest in connection with Udawantnagar P.S. Case No. 461 of 2023 registered under Sections 353, 354(A), 379, 504 and 506 of the Indian Penal Code.

3. As per prosecution case, the petitioners along with other co-accused persons surrounded mother and brother of the informant and assaulted them. It is further alleged that petitioner nos. 1 and 2 ordered the other co-accused persons to shoot the brother and the mother of the informant, then other co-accused persons made indiscriminate firing, on account of which, the brother of the informant died on the spot.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to previous enmity. Further submission is that petitioners no. 1 and 2 are only order giver. Petitioner no. 3 is alleged to have caught arm of the mother of informant. The allegation of firing is against other accused persons. There is no specific allegation of assault or firing against these petitioners. Petitioners are ladies and have got clean antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Udawantnagar P.S. Case No. 461 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
