Learned counsel for the petitioner has submitted that he could not appear to argue the case on 10.10.2017 as he was suffering from cold and fever and, therefore, prayed that Cr. Misc. No. 43945 of 2017 be restored to its original file. Being satisfied with the submission of learned counsel for the petitioner and the averments made in restoration application, this restoration application is allowed and Cr. Misc. No. 43945 of 2017 is restored to its original file with a cost of Rs. 500/- to be deposited by the petitioner to the Patna High Court Legal Services Authority, Patna.
