I have perused the records and find that the action of the Bank in realizing the loan advanced to the petitioner is put to question. The pleadings on record would show that while according to the petitioner, it should have been realized in installment as per the agreement but the complaint is that instead, on retirement of the petitioner, the entire amount was realized from the pension account.

The petitioner does not dispute the action on its validity rather it is the process adopted by the Bank which has been put to question. In my opinion, the action taken by the bank would

Patna High Court CWJC No.21796 of 2012 (2) dt.14-09-2018 suffer no infirmity for even if the loan advanced to the petitioner was attached to the salary account, the moment he superannuated, it was for the Bank to protect its interest and accordingly action has been taken for realization which suffers no infirmity.

The writ petition is dismissed.
