Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Akodhigola P.S. Case No. 216 of 2019, registered for the offences punishable under Sections 341, 323, 324, 379, 307, 504 and 34 of the Indian Penal Code.
All the accused persons including this petitioner are alleged to have assaulted the informant with iron rod, Chholna and danda, as a result of which he sustained head injury. It is further alleged they also snatched Rs. 6,000/-. It is submitted that petitioner has been falsely
Patna High Court CR. MISC. No.16242 of 2020(2) dt.16-09-2020 2/2 implicated in this case. There is general and omnibus allegation. No specific allegation of any overt act has been attributed to this petitioner. From the injury report, it appears that injuries are simple in nature caused by hard and blunt substance. No case under Sections 379/307 of IPC is made out. Petitioner has got clean anteceent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Rohtas, Sasaram in connection with Akodhigola P.S. Case No. 216 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
