JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner undertakes to remove the defects within four weeks of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner apprehends his arrest in Mansi P.S. Case No.82 of 2020, registered for the offence punishable under Section 395 of the Indian Penal Code.

The informant alleged that eight accused persons on three motorcycles snatched his bag containing Rs.3,76,000/-, charger of laptop and some papers.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.29153 of 2021(3) dt.24-01-2022 2/3 petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the FIR. On the basis of confessional statement of co-accused, the petitioner has been made accused in the present case. It is also submitted that similarly situated co-accused person has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 22.01.2021, passed in Cr. Misc. No.31057 of 2020. It is further submitted that no incriminating article has been recovered from conscious possession of the petitioner. The looted article has been recovered from co-accused, Ranjan Kumar, Pankaj Sah and Suben Kumar.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that similarly situated accused person has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No.82
