Earlier the prayer for bail of the petitioners was rejected by this Court, vide order dated 27.2.2017 passed in Cr. Misc. No.8072 of 2017, with a direction to the learned trial court to expedite the trial and conclude it within a period of nine months.
Submission of the learned counsel for the petitioners is that they in custody for more than one year and no substantial progress has been made in this case and from perusal of the report submitted by the learned trial court, it appears that the trial is likely to be concluded within a period of four months. In such view of the matter, I am not inclined to grant
Patna High Court Cr.Misc. No.60823 of 2017 (3) dt.17-01-2018 2/2 bail to the petitioners, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of four months from the date of receipt of the order. The S.P., Banka is directed to ensure presence of the witnesses in the court concered.
With the aforesaid observation, this application is dismissed.
