Let the defect(s), if any, as pointed out by the office, be removed within four weeks.

The petitioner is in custody in connection with Kishanpur P.S. Case No. 06 of 2021 under section 392 of the Indian Penal Code.

The allegation in the FIR is that the petitioner and the other accused persons on the point of pistol, snatched Aadhar Card, Pan Card and other I.D. including mobile phone and a cash of Rs. 12000/- of the informant.

The police was able to apprehend one Sunil Kumar while the other accused persons managed to escape and was

Learned counsel for the petitioner submits that the said accused Sunil Kumar who was arrested from the spot has since been released on bail by a coordinate bench of this Court in Cr. Misc. No. 15985 of 2022 disposed of on 16.6.2022. Let the same be kept on record.

Taking into account the fact that the petitioner's name has come in the confessional statement of accused Sunil Kumar who has since been enlarged on bail, charge-sheet stands submitted, he is in jail since 17.4.2021 (as stated in para-15 of the bail application) and has no criminal antecedent, this Court is inclined to grant him the privilege of bail. However if it is found he do have criminal antecedent, the bail application shall stands cancelled.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Scamper P.S. Case No. 06 of 2021 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
