ANJANA MISHRA ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.07.2017 in connection with Majhaulia P.S. Case No.290 of 2016 registered for the offence under Section 302/34 of the Indian Penal Code. Mr. Yogesh Charnd Verma, learned Senior Counsel appearing on behalf of the petitioner submits that the entire case is based on pure suspicion and there is no eye-witness to the occurrence. The very fact that the informant was not accompanying the deceased indicates that he could not have seen that the petitioner was standing to kidnap the deceased and do him to death.

No.51995 of 2017 (2) dt.10-11-2017 2/2 Considering the fact that there being serious cloud on the prosecution story and also because as on date there being no case against the petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Majhaulia P.S. Case No.290 of 2016.
