JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.5.2018 seeks bail in Dhamdaha PS Case No. 267 of 2017 registered under Sections 302, 120B and 34 of the IPC and Section 27 of the Arms Act. Accusation is that the informant was intercepted by the accused persons and Anand Singh, Manish Singh and Manoj Paswan exhorted Monu Dubey to open fire, consequently Monu Dubey opened fire causing death of Pintu Singh.

Learned Counsel for the petitioner submits that the petitioner is only said to be order giver, there is no accusation against the petitioner of killing the deceased rather the same is specific against Monu Dubey, the petitioner has no criminal antecedent and Anand Singh, another order giver, was also granted bail by this Court. Having considered the said facts and circumstances, the petitioner, namely, Manoj Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Purnea in connection with Dhamdaha PS Case No. 267 of 2017.
