The petitioner apprehends arrest in a case registered for offence punishable under section 30a and other ancillary sections of the Bihar Prohibition and Excise Act. Police caught a person named Atmaram Yadav carrying 20 bottles of 375 ml each foreign liquor on a motorcycle which is said to be registered in the name of the petitioner.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Nothing has been recovered from his conscious possession and he is no way concerned with the recovery as he has already sold the said motorcycle to said co-accused.

In view of the allegation of transportation of foreign liquor using petitioner's motorcycle, prayer for bail of the
