Mr. Krishna Kant Singh, learned counsel for the petitioner, after vehemently arguing the case for some time and pointing out that charges have already been framed, seeks permission to withdraw the instant application with liberty to file an appropriate application, raising all the grounds as have been taken herein, before the learned Trial Court at an appropriate stage.

3. Permission is accorded.

4. Mr. Pancha Nand Pandit, learned Addl. Public Prosecutor for the State is also present.

5. The application is, accordingly, dismissed as withdrawn with liberty to the petitioner to file an appropriate application before the learned Trial Court at an appropriate stage, raising all the grounds as have been taken in the instant application and if such an application is filed, the learned Trial Court shall consider and decide the same on its own merit in accordance with law, without being prejudiced by the present order as this Court has not expressed any opinion on the merit of the case.

6. With the aforesaid liberty, the application stands dismissed as withdrawn.
